This Website is provided for informational purposes. Nothing on this Website constitutes legal advice or creates a solicitor-client relationship. A solicitor-client relationship is only established upon execution of an Engagement Letter.

5. Service Engagement
Engagement of Caskwell's services is subject to a separate Engagement Letter, which will set out the specific scope, fees, and terms applicable to your matter. These Terms and Conditions apply alongside any Engagement Letter and, in case of conflict, the Engagement Letter will prevail with respect to the specific engagement.
6. Fees and Payment
Fees are agreed prior to the commencement of any matter and are set out in the Engagement Letter. Applicable fees are denominated in Malaysian Ringgit (MYR). Where professional fee scales are prescribed by the Solicitors Remuneration Order, those scales apply. Disbursements — including government fees, stamp duties, and registration charges — are charged separately at cost.
Invoices are payable within fourteen (14) days of issue unless otherwise agreed in the Engagement Letter. We reserve the right to suspend work on a matter in the event of non-payment.
7. Cancellation and Refunds
Once work has commenced on a matter, fees incurred to date are not refundable. If you wish to discontinue an engagement, please notify us in writing. We will issue a final invoice for work completed to the date of termination.
8. Intellectual Property
All content on this Website — including text, structure, and design — is owned by or licensed to Caskwell. You may not reproduce, distribute, or create derivative works from this content without our prior written consent. Documents prepared specifically for your matter remain subject to copyright but you are granted a licence to use them for the purpose for which they were prepared.
9. Confidentiality
All information provided to us in the course of an engagement is treated as confidential and subject to legal professional privilege. We will not disclose your information to third parties except as required for the performance of your matter, as required by law, or as described in our Privacy Policy.
10. Limitation of Liability
To the extent permitted by Malaysian law, Caskwell's liability in connection with any matter is limited to the fees paid in relation to that specific matter. We are not liable for any indirect, consequential, or economic losses arising from your use of this Website or from our services, except where such limitation is not permitted by law.
Nothing in these Terms limits our liability for fraud, gross negligence, or any liability that cannot be excluded under applicable Malaysian law.
11. Indemnification
You agree to indemnify and hold Caskwell harmless from any claims, losses, or expenses (including reasonable legal fees) arising from your misuse of this Website or breach of these Terms.
12. Termination
Either party may terminate a services engagement by providing written notice. Termination does not affect rights or obligations accrued prior to the termination date. Clauses relating to confidentiality, intellectual property, and limitation of liability survive termination.
13. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of Malaysia. Any dispute arising from your use of this Website or from a services engagement shall be subject to the exclusive jurisdiction of the courts of Malaysia, unless otherwise agreed in a specific Engagement Letter.
14. Dispute Resolution

15. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue to apply.
16. Entire Agreement
These Terms, together with any applicable Engagement Letter and our Privacy Policy, constitute the entire agreement between you and Caskwell regarding your use of this Website and engagement of our services.
17. Changes to These Terms
We may revise these Terms from time to time. Changes will be posted to this page with an updated "Last Updated" date. Your continued use of the Website following any changes constitutes acceptance of the revised Terms.
